A nosso ver, o subsistema de normas prim?rias tende naturalmente a um estado de desordem m?xima, no qual as estruturas tendem a desparecer. A estrutura desse subsistema de normas prim?rias ? definida pelo subsistema de normas secund?rias, sendo que a pir?mide kelseniana ? a sua forma mais improv?vel. According to Hart, the legal system is comprised of two subsystems: one that contains the primary legal rules, that govern conducts, and another that contains the secondary legal rules, that allow the creation, alteration or extinction of primary rules. The subsystem of primary legal rules tends to a state of maximum disorder, where its structure tends to disappear. The structure of this subsystem is determined by the subsystem of secondary legal rules and Kelsen's pyramid is its least probable shape.
