It took the courts 8 years to determine that HERA 2008 was meaningless and FHFA as conservator can do whatever it wants without limitation. What remains to be seen is the extent to which they can violate contracts, whether they can do whatever they want when they are being run by an unconfirmed director, whether their broken structure would have prevented Trump from gettin them out of conservatorship and if that means a court can place an injunction that forces the government to get them out of conservatorship, and whether, while doing whatever they want and that is taking everything --- if the Supreme Court will ignore that it is a takings. The way the law is currently being interpreted, the FHFA CAN steal everything for nothing and it isn't a takings, which is bordering on insanity, but it is the hallmark of government fraud and corruption.
