The law as it pertains to the interception of protected broadcast signals has been throughly documented with regards towards its application concerning broadcast services. However, as technology advances so does the methodology for effective communication. Historically, broadcast signals were treated as audio and visual communications and laws were created which mainly focused on ownership and intellectual property rights. While some legislation did address criminal acts, the laws are mostly pertaining to very specific use cases and applications. What society is left with as of modern times, is a massive hole where new types of activity by malicious actors is left outside of the purview of current legislation. What this absence of current legal tests, caselaw, and legislation does is to essentially leave scholars and legal professionals to be forced to interpret caselaw that is arguably no longer relevant to the current needs of society. Additionally, the application of such antiquated caselaw typically ignores the underlying technological advancement.
